The Forté Institute Privacy Policy

The Forté Institute® is committed to safeguarding your privacy on its Web site located at www.theforteinstitute.com. We are committed in both words and action. Privacy protection is not new to us; we have been protecting client identifiable data since the mid-1970's. This Forté Institute Privacy Policy does not apply to products or services provided, or information obtained, other than through the Web site. Please read the following policy to understand how your information will be treated. This policy may change from time to time so please check back periodically. If there is a material change in the collection, use, or disclosure practices to which you have previously agreed, we will attempt to send you a notice via e-mail if you have provided us with an e-mail address. Please keep in mind that some of the services mentioned specifically in this policy may not be available on the site at this time. We take privacy very seriously.

What information does Forté collect from me?

Forté collects information in several ways. For example, some personal information is gathered when you request a Forté Communication Style Profile. In connection with your request, we collect your first and last name and your e-mail address. Once you respond to our Forté Communication Style Report request, you are asked to respond to various questions about your communication style, motivations, goals, patience, conformity, perception by others and other such factors. We may ask you to update this information from time to time, including updated information relating to your adaptation to the same or various environments. These responses are used by Forté to create a highly personalized profile that is linked to your personally identifiable information. Similar information is collected in connection with Interaction Reports, Team Builder Reports and trending information. In case studies The Forté Institute contacts clients within groups of similar interests to seek their participation in specific studies and they have the option to be included or not. We also collect your first and last name, e-mail address, phone number and comments when you fill out an on-line contact form to request information about team building programs, coaching and certification. Once you change, to Forté the rest of the way, you are no longer anonymous to Forté and are able to take full advantage of our services. We may also ask you for information at other times, such as when you report a problem with our site or services, or contact the company via the corporate e-mail address. If you contact Forté, we may keep a record of that correspondence.

What are cookies and how does Forté use them?

As part of offering and providing customizable and personalized services, many Web sites use cookies to store and sometimes track information about you. A cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer's hard drive. We may use cookies to allow faster and easier access to your account information, monitor traffic on the site and measure traffic patterns to improve functionality. Forté Web pages may in the future contain electronic images known as Web beacons (sometimes called clear giffs or Web bugs) or other advanced technologies that are useful in the provision of services to you. We may use such devices to verify compliance with our terms and conditions of use or with any promotions on the site.

How does Forté use the information?

Forté's primary goal in collecting information is to improve the site and provide the user with the best possible experience on the site. For example, by using the information collected, we are able to provide you with an easy to use and readily available forum to access your communications profile. We will also use your personal information to notify you of other products or services available from Forté.

Except as provided in this Privacy Policy, only Forté and its affiliates and service providers will have access to individuals' account information. We also may do research on our users' demographics and behavior based on the information provided to us upon registration, gathered from transaction activity, from our server log files or from surveys.

Who is collecting information?

When you are on a Forté site and are asked for personal information, you are sharing that information with Forté and its affiliates and service providers. If personal data is to be collected and/or maintained by any company other than Forté or its affiliates, we will attempt to notify you on the Web site or in an updated version of this Privacy Policy. If you do not want your data to be shared, you can choose not to allow the transfer by not using that particular service.

Please be aware that other Web sites to which we link may collect personally identifiable information about you when you visit those sites. The information practices of other Web sites linked to our Web sites are not covered by this Privacy Policy.

With whom does Forté share my information?

We will not disclose any of your personally identifiable information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below. The following describes some of the ways that your information may be disclosed.

Data in the Aggregate: We may disclose "blinded" aggregated data and user statistics to prospective partners and other third parties, and for other lawful purposes. Blinded data is data which does not identify an individual person. From time to time Forté does publish general information of value to clients and the public, but without reference to any specific individual. This may be in forms ranging from an informal electronic newsletter to a very formal White Paper.

Opt-In Chat Areas: We may offer opt-in chat areas for certain user groups. Any information you disclose in such areas may be seen by all participants in such areas.

Other: We also may disclose your information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating Forté's Terms and Conditions of Use, or may otherwise be causing injury to or interference with (either intentionally or unintentionally) Forté's rights or property, other Forté Web site users or customers, or anyone else that may be harmed by such activities. We may disclose or access account information when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service and improve our products and services.

We occasionally hire other companies to provide limited services on our behalf, including packaging, delivering or mailing, answering customer questions about products or services, sending postal mail, providing investor information and processing data. We will only provide those companies the information they need to deliver the service, and they are contractually prohibited from using that information for any other purpose.

As we continue to develop our business, we may buy or sell businesses or assets. In such transactions, confidential customer information generally is one of the transferred business assets. In the event of a transaction involving the sale of some or all of Forté's businesses, customer and site visitor information may be one of the transferred assets and may be disclosed in connection with negotiations relating to a proposed transaction. In such case, the transferred information may become subject to a different privacy policy.

How can I control my personal information?

Forté offers its customers choices for the collection, use and sharing of personal information. You may contact us at ClientServices@theforteinstitute.com if you wish to view, edit or delete your personal information from our database, and we will use commercially reasonable efforts to accommodate your request.

What security precautions are in place to protect against the loss, misuse or alteration of my information?

Your Forté Account Information and Forté Profiles are password-protected.

  • We use encryption technology for credit card numbers, bank account numbers, passwords and registration information.
  • We use advanced technology to protect your privacy and maintain advanced service levels. We shall continue to enhance our security procedures as new technology becomes available.
  • All client data is stored offline. All Forté databases are on servers that may not be accessed by any other means than The Forté Institute portal server and software, which interacts with the database servers by software code, not internet address protocol. Forté databases may not be accessed directly through the Internet.
  • There are no FTP ports on the Forté servers.
  • There is no secondary access to the Forté servers.
  • The Online servers are for program execution only.
  • The Forté servers are password protected with a 14-digit/1024-bit encrypted process.
  • All sensitive interactivity is protected by SSL 128-bit encryption.
  • Only the proprietary Forté logic can process the Forté data.
  • Each Forté client is provided with a unique 19-digit identification number (ID) and randomly generated personal identification number (PIN). The client may change the PIN at any time. This is the same technology used by the global credit card companies.

Remember to sign out of your Forté account and close your browser window when you have finished your work. This is to ensure that others cannot access your account by using your computer when you are away from it. Because of the global nature of the Internet, when you give us information, that information may be sent electronically to servers outside of the country where you originally entered the information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, information that you disclose by use of this site (as with any site that is non-secure), by posting a message or using e mail, potentially could be collected and used by others. This may result in unsolicited messages from third parties or use of such information by third parties for their own purposes, legal or illegal. As a result, while we strive to protect your personal information, Forté cannot ensure or warrant the security of any information you transmit to us or from our services, and you do so at your own risk. Once we receive your transmission, we use commercially reasonable efforts to ensure its security on our systems.

Choice/Opt-out

To ensure that you will not receive recurring marketing information from us unless you choose to, we will provide you with simple instructions on each marketing email from Forté for you to let us know that you have chosen to stop receiving such emails from us.

The Forté Institute is pro-active in seeking clients to benefit from the Forté process. We will send timely notices when it is time for a client to update their Forté profile information. The client always has the option to opt-in or opt-out…including requesting they no longer receive any notices whatsoever.

What else should I know about my privacy?

Please keep in mind that whenever you voluntarily disclose information online, that information is accessible to other customers and users. Ultimately, you are solely responsible for maintaining the secrecy of your passwords and/or any account information. Please be careful and responsible whenever you are online.

When you or we end your customer relationship with us, we will treat the information we have about you as if you were still our customer.

EU Data Directive Privacy Notice

Forté is committed to compliance with its privacy obligations in the United States and throughout the world. This EU Data Directive Privacy Notice sets forth the privacy principles Forté follows with respect to personal information transferred from within the European Union to the United States. This notice applies to the personal information of European Union Citizens maintained by Forté in the Forté database.

Privacy Principles

Notice: Forté notifies data subjects about the purposes for which it collects and uses information about them. See "What information does Forté collect from me" above. Individuals may contact Forté's privacy director using the contact information provided below with any inquiries or complaints or to request information about the types of third parties (other than third party processors) to which it discloses the information and the choices and means it offers for limiting use and disclosure of personal information.

Choice: Forté will give data subjects the opportunity to choose whether their personal information will be disclosed to a third party (other than third party processors) or used for a purpose incompatible with the purpose for which it was originally collected or subsequently authorized by the individual. Forté will obtain the explicit consent of the data subject for sensitive information to be disclosed to a third party (other than third party processors) or used for a purpose other than its original purpose or the purpose authorized subsequently by the individual. Access: Your profile and account information is easily accessible by you. See "How can I control my personal information."

Security: Forté takes reasonable precautions to protect personal information from loss, misuse, unauthorized access, disclosure, alteration and destruction. See "What security precautions are in place to protect against the loss, misuses or alteration of my information?" above.

Data integrity: The personal information Forté gathers is relevant for the purposes for which it is to be used. Forté takes reasonable steps to ensure that data is reliable for its intended use, accurate, complete and current.

Enforcement: Forté conducts compliance audits of its relevant privacy practices to ensure adherence to this policy. Any questions or concerns regarding the use or disclosure of personal information should be directed to Forté's privacy director with the contact information provided below. Forté will investigate and attempt to resolve complaints and disputes regarding processing and disclosure of personal information in accordance with the principles contained in this policy. For complaints resolved internally, Forté's remedy or, if necessary, sanctions will be reasonable and sufficient corrective action to resolve the complaint, including correcting any personal data, using personal data consistent with these principles, reversing or correcting the effects of noncompliance and assuring that future processing of personal data will be in conformity with the policy, including these principles

Any employee that Forté determines to be in violation of this policy is subject to disciplinary action, up to and including termination of employment.

Complaints that cannot be resolved between Forté and the complainant will be handled by an independent dispute resolution provider such as BBBOnLine. Forté's privacy director will provide the contact information for the independent dispute resolution provider in the event a complaint cannot be resolved. Any complaint referred to the independent dispute resolution provider will be resolved as determined by the independent dispute resolution provider, such as correction of use of a covered person's personal data in a manner consistent with these principles, correction of personal data, or other corrective action necessary to remedy the effects of noncompliance and to assure that future processing of personal data will be in conformity with these principles.

Onward Transfer: Forté uses commercially reasonable precautions to protect against the transfer of personal information to third parties who do not adhere to these principles

Limitations: Forté's adherence to these principles may be limited to the extent required to respond to a legal or ethical obligation and to the extent expressly permitted by an applicable law, rule or regulation.
